Teen guilty of killing 16-year-old Bailey Gwynne to be sentenced today

A 16-YEAR-OLD boy who fatally stabbed his fellow pupil in the heart during a row over a biscuit will be sentenced today.

Bailey Gwynne, also aged 16, died from a single knife wound to the heart after a fight broke out at Cults Academy in Aberdeen in October last year.

The 16-year-old accused, who cannot be named for legal reasons, admitted fatally stabbing Bailey but had denied murder.

The jury took an hour and 40 minutes to find him guilty of culpable homicide after a five-day trial.

The teenager was also found guilty of two other charges of having a knife and knuckledusters at the school between August 2014 and October 2015.

He was detained at HMP & YOI Polmont and will be sentenced at the High Court in Edinburgh.

During evidence, it emerged Bailey — a hard-working fifth year pupil with four young brothers — had a major loss of blood after suffering a single fatal stab wound to the heart during a fight.

The court heard that on the day he was stabbed, Bailey had missed out on a lunchtime trip to the local supermarket as his friends forgot to tell him about the plan.

He was in a corridor with a group of boys and, after refusing a second biscuit to one, made a remark about him getting fatter.

Accounts of the fight differed between witnesses but the jury heard that Bailey, who was on his way out of the corridor, turned and squared up to the accused after he called his mother “fat”.

They both were said to have thrown punches and two onlookers said Bailey had the teen in a headlock when the knife was pulled.

A post-mortem examination revealed Bailey died as a result of a "penetrating stab-force injury to the chest" which went directly into the heart.

Pathologists described the wound as “exceptionally dangerous”. The killer told police as he was handcuffed "it was just a moment of anger".

He later told officers: "I didn't mean to but I stabbed him."
